Terms of Service for Nonprofits


As an organization choosing to participate and benefit from Mohawk Valley Gives, it is required that you agree with the following Terms of Service which sets forth the roles and responsibilities of all participants.
 

  1. I confirm that my organization is itself or is being fiscally sponsored by a 501(c)(3) that serves Herkimer, Oneida and/or Otsego counties in New York, and that we will provide our EIN number, contact info, and a representative’s information for verification.

  2. I understand that GiveGab/Bonterra is an online platform which will safely process all contributions made to Mohawk Valley Gives, and that my organization will receive all the monies that have been donated to my organization less any transaction fees not covered by the individual donor. These monies will be disbursed within 5 to 7 business days via electronic funds transfer/direct deposit as long as my organization’s bank routing and account information have been verified. Donor-advised grants and prize/match/challenge earnings processed through the Community Foundation will be paid by check and mailed to my organization within 30 days of the event end. 

  3. I understand that to receive donations via electronic funds transfer/direct deposit it is my organization's responsibility to provide a checking account that is eligible to receive ACH transfers from GiveGab/Bonterra. I understand that if my organization supplies the wrong type of bank account (such as a savings account) or the wrong account numbers, GiveGab/Bonterra will be in touch! After 120 days, if GiveGab/Bonterra hasn't heard from my organization, they will refund donations back to my donors.

  4. I understand that in the event of a disputed donation GiveGab/Bonterra and their partner gift processor, Stripe, will make every effort to win the dispute by submitting evidence on my organization's behalf. In the case that a dispute is lost, Stripe will attempt to debit my organization’s bank account for the full amount of the disputed donation and donation processing fees. Additionally, the organization may be charged a $10 dispute fee, at the discretion of GiveGab/ Bonterra. If my organization’s account cannot be debited after 90 days, our ability to accept donations through the GiveGab/Bonterra platform will be suspended until the negative balance is resolved.

  5. I understand that refunds for donations made on GiveGab/Bonterra must be approved by an administrator from my organization and requested from GiveGab/Bonterra within four (4) business days of the original date of the donation. If approved, the full amount of the requested refund and donation processing fees will be pulled from my organization’s balance. Any donation refund request made outside of the four (4) business day refund window must be handled outside of the GiveGab/Bonterra platform between my organization and the donor directly.

  6. I understand that as the administrator of my organization's profile on GiveGab/Bonterra, it is my responsibility to grant (authorize) and revoke (unauthorize) administrative capabilities to other individuals within my organization. I understand that I can choose to allow them full administrative privileges or restrict their ability to view donor data within our organization. I understand that GiveGab/Bonterra will not disclose information about my organization to individual users unless those users are administrative users with appropriate permissions.

  7. I agree to utilize nonprofit toolkit materials provided by the Community Foundation and GiveGab/Bonterra to publicize my nonprofit organization's participation with Mohawk Valley Gives in all appropriate outlets such as our website, newsletters, social media channels and email communications, and use the official Mohawk Valley Gives logos and graphics that are provided when doing so in an effort to increase my organization's success on the Mohawk Valley Gives day of giving.

  8. Mohawk Valley Gives is highly driven by social media. With that in mind, I agree to use the hashtag #MohawkValleyGives in all our organization's social media posts that relate to our Mohawk Valley Gives campaign. I also acknowledge that the Community Foundation of Herkimer & Oneida Counties has the right to use the images that are uploaded to profiles and photos posted on social media with the hashtag #MohawkValleyGives for marketing purposes. The organization will be credited. I understand that my organization's staff, board of directors, and volunteers should promote Mohawk Valley Gives over the course of the event using social media.

  9. I agree to not contact press outlets for Mohawk Valley Gives coverage without prior approval from the Community Foundation of Herkimer and Oneida Counties as they have partnerships with all major media outlets in TV, radio, print and online markets and will coordinate coverage, promotion, and interviews. 

  10. I understand that only online donations made through the Mohawk Valley Gives platform and donor-advised grants facilitated by the Community Foundation of Herkimer & Oneida Counties will count towards any prizes and incentives offered as part of the event. I understand that the prize winners chosen on the day are subject to further verification and may be finalized after the event.

  11. I understand that Mohawk Valley Gives makes no warranties or representations as to the success of the Mohawk Valley Gives program or of any individual participant and in no way, directly or indirectly, guarantees any results or the amount of donations. I understand that the Community Foundation of Herkimer & Oneida Counties reserves the right to audit any gift for accuracy, integrity and suspicious activity.

  12. I recognize that as the host of Mohawk Valley Gives, all matches/challenges are subject to Community Foundation of Herkimer & Oneida Counties review and verification, up to and including criteria being subject to change and earnings awarded at the ultimate discretion of the Community Foundation of Herkimer & Oneida Counties. 

  13. I agree to fully complete a nonprofit/participant profile (including the bank verification process as applicable) on www.givemv.org by September 1, 2025. I understand that the Community Foundation of Herkimer & Oneida Counties has final approval of the submitted information and may make changes to the profile after consultation with my organization.
